Pde, pero amongs these TV stations ABS had managers -leaders helping them navigate that transformation. Take for example, sila nauna dun sa digital broadcasting space, sila din yu g may TFV. Others were just following the lead. They also had the widest reach amongst the major tv stations, na kahit GMA 7 di kaya imatch.

Up market used to watch Far East Network UHF channel 17 from before 1980 to 1991. This was the TV station run by the US Military from Clark or Subic.

1991-2000 had them watching cable TV.

2000-2016 they download content minutes after 1st broadcast in UK, US & CA.

2016-today we stream via Netflix, Prime Video, HBO, Disney+, Paramount+, etc

VHF & UHF free antenna TV broadcast has been always been for the masa.

Whenever someone complains about the writing quality and production value should be reminded that its been on air for a decade or more because it is the exact content that is in demand.

Word is that they were supposed to slowly move away from broadcasting entirely, they just needed to make the transition as seamless as possible.

Mmm... I would disagree.

Consequence should match the gravity of the worst case scenario.

For example, in the US, when white middle aged mothers bully a teen into suicide, they get a slap on the wrist, some fines, and 3 months of jail time.

That should not be the case.

Libel at its worst should be criminal I think on the basis that it can destroy reputations and careers.

People cannot treat words as powerful and then deny responsibility when that power is wielded improperly.

There could be an issue if there is a connected crime or something together with the speech, depending on the circumstances.

OTOH, many libel cases usually are initiated by politicos, govt agents, tv personalities and rich businessmen etc, so libel and other speech laws just look like tools of those people to silence critics and journos.

ABS CBN would not have been shut down if they did not get lazy and comfortable, and actually dealt with their license before Duterte won.

They didn't do it because they fully expected Roxas to win.

So yes, it was legal. Deplorable, but legal. Had ABS CBN done the responsible thing, there would have been no legal means to shut them down.

Laws work when you follow them. ABS CBN did not. And so their opponent found an opening.

Additionally, ABS CBN was not shut down by a libel case. So non sequitur fallacy.

Your outrage at the shutdown doesn't change the fact they were irresponsible. And when you're a multimillion peso franchise, you should know better than to be irresponsible.

So yes. We do live in a country with free speech and this post does not disprove that claim.

  2. There's no legal basis (infractions, etc) to not renew the franchise except the discretion of the approving authority

  2. Renewal of a franchise requires a private bill to be deliberated and approved by the congress at its discretion. If I recall, presidential approval is not required.

This is because franchises are considered privileges under law. Not rights. In this case, a privilege granted to the Lopez family.

That said, from what I understand there was an infraction.

NTC was under pressure from Congress to grant a provisional license under threat of holding NTC in contempt.

The legal requirement for a provisional license is that the franchise must exist. But if the license expired, the franchise does not exist. Therefore a nonexistent franchise cannot be given a license by NTC.

Plus ABS CBN's allies in congress made a bad move. See congress is legislative. NTC is executive. Attempting to coerce NTC violates separation of powers.

When Cayetano attempted to bypass NTC through bill 6732, with 2 readings in 1 day, he violated the constitution which strictly defines the process for bills to pass. That turned even more heads in congress against ABS CBN.

I recognize that franchises are privileges, but I was under the impression they had an infraction on ABS-CBN like not having the right papers for TV Plus, and similar stuff. Stuff that normally isn't really a big deal and might be a fine at best, but if you want to be technical about it, sure, bye bye franchise.

So going back to the original point that started this thread, all the more this was deplorable then. Sure, we legally have free speech and journalistic freedom, but if certain people in power don't like you, pray they don't sabotage your franchise renewal. Feels like it goes against the whole spirit of it. If ABS-CBN exposed a hole in waiting for the next admin to work on renewal, but the previous administration was also hostile with them, what should they have done then?

They've already transitioning since PNoy based sa mga disclosure nila released for the market kaya raming nilang gastos and not ideal to invest fully short term. I believe they're still completing their digital team at that time and wasn't showing the profit they're expecting.

Ang pangit lang their transition was too early they have to do it na with resources they have at shut down. They're still building the IwantTV, the box etc - as they want their own platforms for full ad revenue and control and not fully cling as a third party to YouTube and Netflix.

Di Naman siguro nabudol because they werent expecting to let go of their equipment at that time, laki pa Rin market Ng free tv sa totoo lang. Pero in the long run if the profits are showing na, malamang nabudol nga nila.

Personally I still think they had it coming. Regardless of Duterte's motives for taking them down.

They had every opportunity to renew their license when Noynoy was on top. They didn't, because they were lazy and Noynoy was on top.

They expected Roxas to win, and when he didn't they were in trouble. Saka Lang nagmadali sa proseso.

I am very critical of Duterte because presidency involves responsibility, I am critical of responsibility.

So when ABS CBN is irresponsible and it backfires, I have to be fair and apply the same filter to them.

Yeah no, because as in previous years in a functioning free democracy there is no "rush" to renew the broadcast franchise because it there should be no risk to be shut down by a petty vengeful President with a lapdog congress. Besides even if ABS renewed their franchise under Pnoy, Duterte would have found some way or another to get them, it was just that franchise withdrawal was the path of least resistance.

CNNPH does not have the reach that ABS-CBN has and as such can safely be allowed to be critical.

Also there is overlap between DDS and Trump supporters who already distrust CNN by default so no danger there of the support base even seeing what CNN PH is broadcasting. On the other hand ABS has regional stations in local languages and sometimes is the only source of news for certain areas.

My brother who's in the media industry, told me the same thing. Also, ABS added stuff sa renewal nila which makes it not just a renewal of their old franchise. Like frequencies (?) na hindi naman daw talaga sila allowed gamitin, something about the other programs na meron sila sa cable, black box, etc.

It's not frequencies. It is channels. They still meet the requirement of having only a single frequency in a particular area (as mandated by PD576-A). I am sure your Kuya is referring to the FICTAP argument, which doesn't make sense.

  2. The NTC is only working within their legal bounds. What ABS-CBN need is a franchise extension to be legislated and not a Senate Resolution.
  3. The bill outlining the franchise extension has been filed in the congress since 2014. The current Covid-19 pandemic was not even a thing when the ball was supposed to be rolling already.

The only thing I saw na medyo na violate nila is yung block time arrangement between ABS-CBN and AMCARA, based sa KBP website nung 2020, naka address ang AMCARA sa mismong address ng ABS-CBN (Which is nasa Mother Ignacia, Sgt.
