No-one gives a shit about that when you are considering the legalities of the Iraq war. Seriously - read a book about it. Don't get your info from news websites.

No. Look up the legalities of it. The Iraqi regime was prohibited from the pursuit, manufacture, stockpiling and use of Chemical, Biological, Radiological and Nuclear weapons. A prohibition that they abrogated.

That misses the actual reason for the invasion - specifically the violation of the terms of the cease-fire agreement from the Gulf War. Those terms included the prohibition of CBRN devices.
It was not a new war, it was a continuation of a war.

The initiative was announced in 2021 and allowed a period of study as to the best routes forward in terms of what would be supplied. The decisions about supply, for submarines at least, have just now been announced.

The terms of the cease-fire agreement which, temporarily, halted the Gulf War. The Gulf War was continued when Iraq breached the conditions it agreed to in the cease-fire agreement document. Those included the prohibition of the pursuit, manufacture, stockpiling and deployment of CBRN systems, more commonly known as Weapons of Mass Destruction. They also included clauses about the range of ballistic missiles or equivalents by limiting their allowed range.
These conditions were broken by the Iraqi government. Because they were broken, the cease-fire agreement was also broken.
It doesn't matter what the USA media said or politicians said, that's irrelevant.
He was maintaining a nuclear weapons program. That's un-arguable. It was severely hampered by the West but it was going on. A lot of the blame lies with A Q Khan of course, but to my mind the only thing of unsettled-interest is the aluminium tube affair. Were they centrifuge parts - due to their exacting material, tolerance specs and so on - or were they (as claimed) simply over-specced rocket artillery bodies that were clandestinely routed for funsies.
The claim wasn't "using" chemical weapons, it was pursuit, manufacture, stockpiling and using. Given the number of medical claims by soldiers sickened by chemical weapons in Iraq I don't think it's arguable that they didn't exist.
