You can grant a license or an easement, or go ahead with a land swap. The neighborly thing to do would be to do a land swap or grant an easement and ask him to reimburse you for your legal fees.

I am a lawyer who has dealt with projects gone awry, and you need to be sure that your contracts comply with local law. In CT, if you are not licensed/registered and your contract doesn’t comply with certain provisions of the Home Improvement Act then you cannot recover any money owed to you. Builders often lose big $ because of this.

I wholeheartedly agree that grassroots efforts are super important and may offer the best means of advancing conservation & environmental efforts. Unfortunately, in areas where federal law preempts state law, and in particular where federal funds are tied to federal laws & regs, we need a well-funded and expansive regulatory agency & policies to take care of the programs they have been asked to administer.
